Negative information, like unpaid bad checks or overdrafts, typically stays on a ChexSystems report for five years from the report date, though it might be removed sooner if you dispute it or the bank removes it, but generally, paying it off updates the status but doesn't remove the record, as per Bankrate. Federal law allows some items to stay up to seven years, but the five-year mark is standard for most bank activity, notes HelpWithMyBank.gov and Experian.
ChexSystems tracks negative banking history for up to five years and is used by over 90% of U.S. banks and credit unions to screen new accounts. You can get a free ChexSystems report annually and dispute any errors, which must be investigated within 30 days under federal law.
If you want to have your information excluded permanently, you may print, complete, sign and return a ChexSystems Permanent Opt Out Election form. Please complete the entire form. Failure to provide complete and accurate information may prevent the processing of your request.
ChexSystems' clients, which consist mainly of financial institutions, furnish information on closed checking and savings accounts, referred to as reported information. ChexSystems' current practice is to retain reported information for a period of five years.
Opening an account with a ChexSystems report
Some financial institutions may deny everyone who has a ChexSystems report, while others may only deny people with certain types of activity. ChexSystems itself does not approve or deny applications; it merely provides reports to financial institutions.
Ask creditors to update information
Once you've paid your debts, ask the collection agency or other creditor to update your file on ChexSystems. Get payoff information in writing and keep track of receipts or other documents that show you've paid the debt.
How to clear your ChexSystems report
First Convenience Bank, Varo Bank, and Woodforest National Bank offer a second chance bank account. Also, some institutions don't use ChexSystems at all, like Chime, so it's less of an issue. Chime is also recommended as they offer up to $100 in overdraft protection. GO2Bank also offers overdraft protection.
The Expedited Funds Availability Act requires up to the first $275 of a non-"next-day" check(s) to be made available the next day.
Phase 1 will be implemented on October 4, 2025 and Phase 2 on January 3, 2026. Under the new rule, cheques will be scanned, presented, and cleared continuously during business hours, reducing the clearing cycle from the current T+1 days to just a few hours.
Generally, negative information remains on ChexSystems and/or Early Warning Services (EWS) consumer reports for five years. Under the Fair Credit Reporting Act, certain negative information may be reported for up to seven years.
Understanding Serious Delinquency
After 30 days of nonpayment, the loan would be considered delinquent, but if no payments have been made for 90 days or more, the loan would be in serious delinquency.
Based on the information in your disclosure report, ChexSystems will assign you a consumer score between 100 and 899. The higher your score, the lower risk you present to a bank as an account holder.
If your blacklisting stems from a default judgment, it won't be removed just because the debt is paid. You must apply to the court to rescind the judgment — and this is a legal process.
Negative information typically stays on your ChexSystems report for five years from the report date, though some negative items can remain for up to seven years under certain federal regulations, but you can dispute errors or pay debts to potentially get information removed sooner or updated to show "paid in full". Financial institutions use this history to assess risk for new deposit accounts, so resolving issues is key to getting approved for a bank account.
Opt Out. By submitting an opt out request, you are requesting that ChexSystems exclude your name from prescreen lists used to send a solicitation of credit or insurance for a period of five years.
