When does capital gains tax not apply? If you have lived in a home as your primary residence for two out of the five years preceding the home's sale, the IRS lets you exempt $250,000 in profit, or $500,000 if married and filing jointly. The two years do not necessarily need to be consecutive.
Any gain over $250,000 is taxable.

Everyone is entitled to an allowance, which is an amount of capital gains allowance they can make each year without incurring CGT. It's £3,000 for the current tax year 2024/25. This is down from £6,000 in the 2023/24 tax year. Profit below this amount is exempt from any capital gains tax.

Here's how it works: Taxpayers can claim a full capital gains tax exemption for their principal place of residence (PPOR). The measure
The Chancellor has confirmed that the capital gains tax (CGT) annual exempt amount will be reduced from £12,300 to £6,000 from 6 April 2023 and to £3,000 from 6 April 2024. This measure is forecast to raise £1.6 billion by the end of the 2027/28 tax year.
For individuals over 65, capital gains tax applies at 0% for long-term gains on assets held over a year and 15% for short-term gains under a year. Despite age, the IRS determines tax based on asset sale profits, with no special breaks for those 65 and older.
Use tax-advantaged accounts
Retirement accounts such as 401(k) plans, and individual retirement accounts offer tax-deferred investment. You don't pay income or capital gains taxes on assets while they remain in the account. However, you will pay income taxes when you withdraw money from the account.
