If the collection agency refuses to settle the debt with you, or if the agency or creditor agrees to settle, but you renig on your end of the agreement, the collection agency or creditor may decide to pursue more aggressive collection efforts against you, which may include a lawsuit.

Unfortunately for individuals dealing with debt, a creditor is under no obligation to negotiate a settlement, according to the Federal Trade Commission.
When creditors refuse payments, it's usually because company policy prohibits it. It can't hurt to ask and if your first offer is declined, ask what they feel is an acceptable payment. You may have to negotiate for awhile and what ever you do, DO NOT agree to terms that you cannot afford.
Typically, a creditor will agree to accept 40% to 50% of the debt you owe, although it could be as much as 80%, depending on whether you're dealing with a debt collector or the original creditor. Cons of Debt Settlement
You must be patient. The process of funding an escrow account large enough to enable the debt settlement company to make an attention-getting offer to your creditors typically takes 36-48 months.
Working with the original creditor, rather than dealing with debt collectors, can be beneficial. Often, the original creditor will offer a more reasonable payment option, reduce the balance on your original loan or even stop interest from accruing on the loan balance altogether.
If your misstep happened because of unfortunate circumstances like a personal emergency or a technical error, try writing a goodwill letter to ask the creditor to consider removing it. The creditor or collection agency may ask the credit bureaus to remove the negative mark.
Making a payment on the debt will likely reset the statute of limitations — which is disastrous. If the collection agency can't show ownership of the debt. Frequently, the sale of a debt from a creditor to a collector is sloppy. A collection agency hounding you may not be able to show they actually own your debt.
Generally speaking, having a debt listed as paid in full on your credit reports sends a more positive signal to lenders than having one or more debts listed as settled. Payment history accounts for 35% of your FICO credit score, so the fewer negative marks you have—such as late payments or settled debts—the better.
You may have more room to negotiate with a debt collector than you did with the original creditor. It can also help to work through a credit counselor or attorney. Record your agreement. Sometimes, debt collectors and consumers don't remember their conversations the same way.
If you have a collection account that's less than seven years old, you should still pay it off if it's within the statute of limitations. First, a creditor can bring legal action against you, including garnishing your salary or your bank account, at least until the statute of limitations expires.
A “drop dead” letter is written notification from you to any collection agencies that are harassing you. It informs the agencies that you're aware of your rights under FDCPA and that you're requesting they stop contacting you about a given debt — effective immediately!

The short answer to this question is No. The Bill of Rights (Art. III, Sec. 20 ) of the 1987 Charter expressly states that "No person shall be imprisoned for debt..." This is true for credit card debts as well as other personal debts.
If you have unpaid debts, it may be tempting to screen or ignore your calls to avoid talking to a debt collector.
